港大生與13歲援交女共浴口交 終極勝訴脱非禮罪
13 歲女童聲稱「暑假無事做」及對援交好奇,假裝17 歲於成人網站招客,事件被揭發後,多名曾與她發生性行為的男子被捕,其中已有女友的香港大學三年級男生,聲稱因女童身材豐滿,沒懷疑其年齡,獲裁判官信納,裁定他非禮罪名不成立,惟律政司認為非禮兒童屬「絕對責任罪行」,不知年齡不能成抗辯理由,早前上訴得直。港大生不服,向終審法院提出上訴,法官今(9日)頒下判辭,一致裁定港大男生終極勝訴兼獲訟費。
真誠相信已成年是辯護理由
終院法官今在判辭指,認爲本案所涉「向16歲以下兒童作出非禮行為」的控罪條文,毋須把事主年齡視之為「絕對法律責任」,對於早前有法官裁定因女事主只得13歲,並認為這構成絕對法律責任罪行是錯誤的。
但終院法官認為,視16歲以下的女孩和男孩爲易受傷害類別,需要高度保護,以抵抗猥褻侵犯,(即認為這些兒童無能力對猥褻侵犯的行為給予同意),仍是合理的,他們認為較佳的做法是,控方不用證明被告是否對女孩的真實年齡知情,然而,若被告人能證明他很可能真誠並合理地相信女孩爲16歲或以上,他就有良好的免責辯護理由。
本案被告蔡偉麟,在審訊時曾已自己真誠相信事主已17歲,他有良好抗辯理由,亦獲裁判官接納。故終院亦裁被告上訴得直,維持裁判法院裁定他罪名不成立裁決。
控方認為屬絕對責任罪行
律政司早前上訴時指出,侵犯16歲以下兒童的非禮罪是一項「絕對責任罪行」,即控方毋須證明被告是否知悉事主的年齡,或是否有犯罪意圖,只要控方能證明被告曾與16 歲以下事主作出非禮行為,便能被裁定有罪。
高院暫委法官陳廣池早前同意律政司看法,認為16歲以下兒童應受保護,故認為被告所涉控罪應列作「絕對責任罪行」,並裁定該名港大生因曾與未成年女童口交,便應裁定非禮罪成。
但陳官亦基於案件牽涉對公眾有重大而廣泛重要性的法律爭議,批准被告就案件到終院上訴,並就《刑事罪行條例》第122 條(2),16歲以下人士,在法律上是不能同意非禮行為,即被告不能因16 歲以下人士同意其猥褻行為而獲得免責,提出爭辯。
被告堅稱相信女童17歲
被告蔡偉麟,24歲,被控2014年暑假時,非禮當時只得13歲的援交少女,蔡與少女在成人網站接洽,少女寄給他一張半身照,又自稱已滿17歲,二人其後相約到時鐘酒店開房,蔡對少女上下其手,少女亦為他口交,蔡事後給對方1千元肉金。
控方案情指出,2014 年8 月4 日,蔡與女童前往時鐘酒店一起洗澡,支付女童750 元讓女童為他口交。蔡自辯時形容,女童「胸部好大,有33、34(吋)」,並稱出身男校性經驗少,未能判斷女童的真實年齡。

The Court of Final Appeal has overturned the indecent assault conviction of a man who bought sex services in 2014 from a 13-year-old girl who claimed to be 17.
The man, who was 22 and a university student at the time, was originally acquitted by a magistrate in 2015 who heard evidence from the girl and ruled that she really looked more mature than her actual age, and that she had admitted she would try to dress to look older when meeting clients. The magistrate noted that the girl had given consent to perform sexual acts.
But the prosecution appealed, and in 2017 the High Court decided the man should be found guilty. The judge said it is because anybody aged under 16 is unable to give consent in a legal sense. The court said, therefore, the man bore absolute liability for the offence.
He took the case to the top court which ruled on Wednesday in his favour.
The five-judge panel said that while there is a need to provide girls and boys aged below 16 a “high degree of protection against sexual exploitation”, in this case, it was more probable than not that accused “honestly and reasonably” believed the girl was over the legal age limit. |
