Retired police superintendent Frankly Chu has told his assault trial that police guidelines on the use of force is "only for reference", and he had only used "appropriate and restrained" force when he used his baton to control a crowd in Mong Kok during the Occupy protests in 2014.
Questioning Chu in Eastern Court, a prosecution lawyer noted that internal police guidelines suggest that officers should only use their batons when faced with "active aggression", and that they should only hit specific body parts to cause "temporary injury-free motor dysfunction".
Asked whether he had complied with these guidelines, Chu said they're only for reference, and that one has to look at the bigger picture. He said it would have been utterly impossible for him to make fresh assessments "every second" on what degree of force should be used.（佢話!完全不可能每一秒鐘都可以作出即時評估，用幾多程度嘅適當武力!)
However, he added that this does not mean that officers use force arbitrarily, and right before he hit alleged victim Osman Cheng, he had "thought about" how not to cause him any serious injury. (但係轉頭佢就話: 正正在佢揮打姓鄭途人之前, 就即時諗過點樣令到佢不受到任何嚴重傷害!)
Chu also said he had to use force to disperse what he described as a "mob" in Mong Kok on the evening of the alleged assault, and he had no time to ask each and every person there whether they were a protester or not.
Chu has finished giving evidence at the trial.
