早前到英國舉報梁振英UGL涉貪事件的民主黨立法會議員林卓廷，昨日他收到英國執法機構國家打擊犯罪調查局National Crime Agency Director General: Lynne Owens CBE QPM MA書面回覆，信函內容為已知悉林卓廷已與Bribery and Corruption Intelligence unit（BIUC）見面，她已指示相關負責人檢視相關資料，研究案件是否屬英國的司法管轄範圍，若有關部門完成有關行動，會進一步回覆林卓廷下一步行動。
林卓廷感謝Ms Owens親自回覆，顯示對方非常重視梁振英涉貪案。他今日將再電郵Ms Owens表示會提交進一步資料，證明投訴屬英國司法管轄範圍，包括他正尋求英國執業大律師的法律意見以證明案件屬英國司法管轄，因為梁振英當時為戴德梁行董事，該公司當時屬於英國上市公司，案件涉英國小股東及債權人權益，亦涉英國上市公司的收購協議，因此有理由相信屬英國司法管轄權。若再有最新進展，林卓廷將向公眾交代。
林卓廷指，稍後聯絡英國的執業大律師意見後，將會書面提交補充資料予英國的National Crime Agnecy，希望該機構能盡快展開調查，若有進一步行動和進展，會再向公眾交代。
林卓廷指，對於立法會專責委員會跟進梁振英UGL案件，他從不寄予厚望，因為建制派一直拒絕讓專責委員會引用權力及特權法，去傳召證人和搜集文件證據資料，加上建制派在委員會中佔多數。林卓廷又指，今次到英國作出刑事舉報，其實與立法會專責委員會進展和結果無必然關係，因為委員會只是調查涉及香港，尤其梁振英作為特首是否有利益衝突等問題，他今次到英國舉報，則是質疑梁振英作為英國上巿公司戴德梁行董事時，接受UGL400萬英磅達成交易的做法，已違反英國當地的反貪法例，因此英國執法機構有需要作出全面調查，以維護巿場的秩序和小股東和債權人的權益。
UK looking into CY Leung's UGL affair: lawmaker
Concerns have been repeatedly raised about a HK$50 million deal former Chief Executive CY Leung made with an Australian engineering firm.
Democratic Party legislator Lam Cheuk-ting said on Wednesday that the UK's National Crime Agency (NCA) is reviewing documents he provided alleging misconduct by former Chief Executive CY Leung over his dealings with Australian firm UGL.
Lam said the NCA had informed him it would be seeking to ascertain whether any criminality occurred within its jurisdiction.
The lawmaker flew to the UK earlier this month to raise his concerns about a HK$50 million deal Leung struck with UGL in connection with the company's takeover of real estate services firm DTZ, which was listed in the UK. Leung was a director of the DTZ.
"I have reason to believe that it is undoubtedly a UK suspected corruption case since DTZ is a former listed company of the UK," Lam said.
"The agreement between CY Leung and UGL may jeopardise the interests of the shareholders of the UK-listed company and also jeopardise the interests of the creditors of DTZ."
Leung stepped down from the board of DTZ before he declared his candidacy for the 2012 CE election. But he is believed to have received HK$50 million in two instalments from UGL after he took office.
Concerns have been raised about whether Leung declared the payments to the Executive Council and the chief justice, whether he should have paid tax on the money, and if the deal posed a conflict of interest.
Earlier this month, legislators complained that Leung was not cooperating with a Legco probe into the affair. |
