警證供矛盾 搭棚工沒律師代表 自己打甩

搭棚工蔡浩民（25歲）去年10月19日佔領運動期間，於旺角惠豐中心對開，與其他示威者向警員進逼，並撞向警員的盾牌，被控抗拒警務人員罪。搭棚工今沒律師代表，親自處理審訊，結果裁判官指兩名警員的證供有矛盾，裁定被告罪名不成立。

被告沒有律師代表，稱因沒時間入數聘用當值律師。被告蔡浩民庭上稱當日他站在後排，身後有鐵馬，沒法後退。他在庭外指，當天事發前要上班，身上有鋸和搭棚用的棚刀，原被控藏有攻擊性武器罪，他本來打算認罪，並在一月踢保，但警方4月突然致電他，改控抗拒警務人員罪。被告指自己沒做過，故不認罪，更表示：「告我無所謂，但唔好屈我」。

裁判官裁決時指，警員李嘉豪供稱當時亦有其他示威者衝擊，但他當天視線沒離開過被告，與同事商量後決定拘捕他，故幾人一同上前制服被告，但另一警員則供稱，是他自己一個人制服被告，後才有其他警察上來協助。裁判官指兩人證供有矛盾，疑點利益歸於被告，判被告無罪。

The prosecutor should have been able to establish a reasonably strong case before initiating the prosecution so as to avoid wasting time and money of all parties concerned.  The fact that the accused was acquitted without even being represented by a lawyer indicated that the case was quite weak.  The prosecutor was not even able to notice that there was contradiction between witnesses' statements.  This has nothing to do with ICAC but the Department of Justice.

Agreed.

I didn't think the prosecutor has taken any money so that would be nothing do with ICAC.

However, his/her supervisor should review the performance.

律政處会睇的。如法官出錯，可能会上訴呢。
